Westbank First Nation (WFN) is comprised of five reserves. Tsinstikeptum Reserves 9 and 10 border Okanagan Lake and are in close proximity to the City of Kelowna, one of the fastest growing cities in British Columbia. Unlike most First Nations across Canada, WFN Lands are not governed under the Indian Act. Rather, WFN Lands are governed under a comprehensive set of community laws. WFN has full jurisdictional control over its Lands and resources. WFN is governed under the WFN Self Government Agreement, an agreement between WFN and the Government of Canada. The use and development of Westbank Lands is subject to Part XI of the WFN Constitution ("Land Rules").

Land rules

Section 1.1.1 of Land Rules: "Interest in, and instruments which affect, or purport to affect, Westbank Lands shall be registered or recorded in the Westbank Lands Register." 

The WFN Land Registry is a sub registry under the Self-Governing First Nations Land Registry held in Ottawa. It is a public registry that is password protected and can be accessed at no charge through the Helpdesk on the systems login page.   1. Select language
  2. Read and accept Use Policy
  3. Create an account (if a new user)
  4. Log In
  5. Continue
  6. To search for a parcel abstract report (title search) under the heading click onto "Search Land"
  7. Under tab Select Criteria, select SGFNLRS
  8. Under the field Legal Description, type in Lot and the No., or the Unit # within the Lot, No., then select add button
  9. Next screen page indicates Land Search Results. Under Legal Description, click on the Lot No. displayed. If two Lot No.'s appear, you will have to select the correct plan no. and/or reserve no.
  10. Screen page displays the Land Details. To view all associated instruments, the Abstract Report must be selected in order to generate in a new window.

Regulations

The WFN Land Registry Regulations are Federal regulations enacted under authority of the WFN Self Government Agreement and work in conjunction with the Land Rules. In the event of a conflict, the Regulation will prevail with respect to the registrations of interests in Westbank Lands.

  • According to time and date of registration (s.28)
  • Registered mortgage has priority of subsequent registered interest (s.30)
  • Interest registered before Regulations have priority over those registered after Regulations came into force (s.33)

For the effective administration of the Land Rules, WFN uses prescribed Forms for use in the registration of instruments dealing with or affecting Westbank Lands. The Westbank Lands Office pursuant to the Land Rules has a responsibility to register instruments which affect or purport to affect Westbank Lands.

*All additional pages using the WFN-01 to WFN-04 forms must be prepared on the WFN-06 Schedule Form, with some exceptions. Contact the WFN Lands Office for further clarification if required.

Registration process

Depending on the amount of transactions our office has received for processing, it typically takes one to two days for a pending file to be “Received” and up to five days for the document to be “Registered” in Ottawa.

Step 1: A minimum of one originally executed document, prepared using the appropriate WFN Form for the transaction, is submitted along with the appropriate registration fee to the Westbank Lands Office. (WFN Land Rules s.99.2(d), 99.5 and 111). If you wish to have a registered copy of the document returned to you, a prepaid self addressed envelope (fitting the size of the document) or a prepaid courier waybill must be included with your submission.

Step 2: The WFN Lands Office will review the transaction and, if acceptable, approve to Form only. The documents are then scanned and forwarded by electronic transmission to the Self-Government First Nation Lands Registry (SGFNLR) in Ottawa. (WFN Land Registry Regulation 11) 

Step 3: The SGFNLR system will provide an electronic acknowledgment of receipt, which provides the tracking number for the transaction. (WFN Land Registry Regulation 14)

Step 4: Confirmation of Registration will be provided upon completion of the Registrar’s review in Ottawa. The document will be considered to have been registered or recorded at the time indicated on the electronic acknowledgement of receipt. Priority will be in effect according to the time and date of registration. (WFN Land Registry Regulation 20(2)(a), 28(1))
