Westbank First Nation Law Enforcement Officers are authorized under certain WFN Laws and the WFN Notice Enforcement Law to issue notices (tickets) for contraventions of WFN Laws.

Receipt of an Enforcement Notice

Within 14 days of receiving an Enforcement Notice, you must:

(a) pay the penalty in accordance with the Enforcement Notice; or
(b) request to dispute the penalty in respect of the allegation made in the Enforcement Notice in accordance with instructions on the notice.

You may pay the indicated penalty after 14 days of receiving the Enforcement Notice, subject to the applicable surcharge for late payment, but no person may dispute the Enforcement Notice after 14 days of receiving the Enforcement Notice.

Fines

How to Pay your Ticket

You may pay your ticket either in person or by mail.

In person

Pay in person with cash, cheque, debit, money order, VISA, or MasterCard to the cashier at the address below during regular business hours. Present a copy of the Enforcement Notice, along with your payment.

By mail

Send your cheque or money order (payable to Westbank First Nation) in Canadian funds to the address below. Do not send cash in the mail. A receipt will not be sent back to you.

Your payment must be accompanied by a copy of the Enforcement Notice, or a note giving sufficient information to identify the Enforcement Notice, including:

  • The Notice Number (from the top right corner of the ticket)
  • The name on the ticket or vehicle plate number identified on the ticket
  • Your mailing address
  • The date of offence, the name of the law and section of the offence

If sufficient details are not provided, your payment may not be credited, and legal proceedings may be commenced against you. A dishonored cheque will not be considered payment of the penalty within the prescribed time. Additional charges will apply for NSF cheques. Postmarks are not accepted as date of payment.

Payment Terms

If payment is received within 14 days of receiving the ticket, the penalty amount is the Early Payment Penalty as referenced on the ticket.

If after 14 days payment is not received and a Dispute Notice (application for adjudication) has not been filed, the penalty amount is the Penalty Amount as referenced on the ticket.

After 14 days, the opportunity to dispute the ticket is lost.

If after 28 days, payment has not been received, the penalty amount is the Late Payment Penalty amount and is immediately due and payable. Westbank First Nation may then file a Certificate with the Provincial Court, and action may be taken on the Certificate as if it was a judgment of the Provincial Court and/or the ticket may be forwarded to a collection agency.
