Westbank First Nation Law Enforcement Officers are authorized under certain WFN Laws and the WFN Notice Enforcement Law to issue notices (tickets) for contraventions of WFN Laws.
Ticket disputes must be requested within 14 days of receiving a law Enforcement Notice. Appeals are heard by third-party adjudicators whose decisions are binding on the Westbank First Nation government and the person disputing the notice. Instructions for disputing a Notice are printed on each Notice.
Dispute application form
When you dispute your ticket, your application will be forwarded to WFN's Screen Officer. The Screening Officer will review the Enforcement Notice, the application, and the circumstances surrounding, and either cancel the ticket or forward the application to adjudication.
An Adjudication Hearing is similar to a court hearing and provides an opportunity for individuals to have their disputed ticket heard by an independent, neutral Adjudicator.
Upon hearing the evidence, the Adjudicator will render a decision as to whether the offence did or did not take place.
If a person is unsuccessful in a dispute adjudication, a $40.00 adjudication fee is added to the penalty.
If the Adjudicator renders a decision that the offence did not take place, the ticket and all associated charges are cancelled.
